Cease and Desist Order for Ogden Canyon Wall

Our friends at the Ogden Valley Forum did an exemplary job of investigative reporting in their January 1, 2011 issue.

In the first in a series of hot topics from this issue we read:

Cease-and-Desist Letters Fail to Stop Work on Eyesore in Ogden Canyon

The wall was built without the required permits from the Weber County Planning Office.  According to (Iris) Hennon, two "Cease-and-desist letters" were delivered - one to the contractor, and the other to the Perry Family Foundation; the first letter went to the contractor on December 7 and the second on December 14 to representatives of the Peery Family Foundation who live across the river behind the newly constructed was.  The letters failed to stop the work on the fence, which has almost been completed - despite the cease-and-desist orders.
Surveyors have been seen near the site in recent weeks but as recently as this afternoon work was continuing on the unpermitted eyesore.

Will this be another case of the County Commissioners slapping the hands of the Peery family in a classic 'ask for forgiveness rather than permission' case?

Our bet is yes.

  1. Commissioners---- "Tear Down That Wall". Get off of your duffs and enforce the codes for a change. When these contractors and builders spit in the face of County authority, they should pay for it.

  2. If the County does not take decisive action on the wall, it opens the door for anyone else in the County to do as they wish without regard to permits or building requirements.

  4. Think about the Helicopter last year. No permits and the Weber County Commissioners reward that bad behavior by speeding up the process to allow them to operate anyway. Take note Ogden Valley residents, take advantage of their poor oversight in Weber County and do whatever you wish.

I'd like to see what the results of the survey are...if in fact if that fence is on county property or any other property that is not the Perry's....its an obnoxious wall to say the least...they could have at minimum got the color right...that part of the canyon is tan...the gray is further up.....also like UDOTS response..."its not our property"....on another note about UDOT and the canyon....given that the canyon is a no passing zone, how about a little signage at both ends pointing that out...or would that take a 5 year study from them and 2 million dollars for a thousand dollar sign?

  7. This exact same wall is in the canyon already. So why get so upset? Yes, I would rather not see the wall as I drive by but if WE lived there and if WE wanted a little privacy or to quite from all the traffic, would WE want to protect our property? We only have to look at it for a few seconds, they have to look at it 24/7. I hope the owners done drive my property and complain about my fence. We might be thanking them for that fence depending on what they build next.

  8. I like the world of Brian L. Belnap no rules. We should ignore all the rules that don't suit us. Everyone does their own thing, how cool.

    If you want a better view, put up a 12 story building along Pinview. Who cares about permits and other rules?

    We can all have a lot more fun with no rules to mess with. We can just dump our raw sewage into the local river.

The issue is not about their rights...its about them not following the building code...anyone can build all they want as long as they follow the rules ....I think its still in question whether the are on their own property. The contractor knew damn we'll hr was building without a permit...yet still kept going even after 2 stop work orders...

  13. Looks like the old heliport is back on the county agenda for January 25 per the Ogden Valley News...nice editorial too about developers changing thier property tax to "greenbelt" while the rest of us carry the costs of running the place.....
